Pure You or its licensors own the copyright to the documents and material on the Pure You Site. This material is authorized for personal, non-commercial use only. You may download, print, and store copies of this material for your own personal, non-commercial use. Nothing on the Pure You Site should be interpreted as granting, by implication or otherwise, any license or right to use any trademark or service mark displayed on the Pure You Site without the written permission of Pure You or any third party that may own such trademarks or service marks. Pure You will take necessary measures to enforce its intellectual property rights to the fullest extent of the law.

Pure You, the Pure You logos, and any other product or service name or slogan contained on the Site are trademarks of Pure You and/or its licensors and may not be copied, imitated, or used, in whole or in part, without prior written permission from Pure You or the applicable trademark holder. You may not use any metatags or any other "hidden text" containing "Pure You" or any other name, trademark, or product or service name of Pure You without prior written permission. All other trademarks, registered trademarks, product names, and Pure You names or logos mentioned on the Site are the property of their respective owners.

You have been granted a personal, limited, and non-sublicensable license to access and use the Site. You may electronically copy and print hard copies of certain portions of the Site materials for personal, informational, and non-commercial use only. Unless explicitly stated herein, nothing in these Conditions shall be construed as conferring any license to intellectual property rights, whether by estoppel, implication, or otherwise. This license may be revoked at any time.

Pure You is dedicated to providing up-to-date and accurate information on our websites, email, chat, and telephone communications. However, we do not guarantee that all information provided is always correct, accurate, or complete. Occasionally, system or typographical errors may cause data, including prices, to be inaccurately displayed on our Site. Such errors or inaccuracies are not binding on Pure You and may be corrected at any time. Pure You reserves the right to correct any errors that occur. If an order is placed for a product listed at an incorrect price, Pure You may, at its discretion, notify the customer before shipping the product or cancel the order and inform the customer of the cancellation. Pure You regrets any inconvenience this may cause.

The information we provide is not a binding contract and should not be treated as such. If a customer acts on incorrect information, the sole remedy is to request the cancellation of the order. If the order has been shipped, the customer agrees to either return the product for full credit or pay the difference between the actual and charged prices. Please refer to our Return Policies for further information.

Pure You holds a dynamic and high volume inventory. The stock availability on our website is listed "as is" and is subject to change. If a product in an order is out of stock, we will advise the customer immediately with possible options. Products may appear on the Pure You website larger or smaller than their actual size. Given the variation in computer monitor settings, color and size may vary slightly when viewing product photography. In compliance with industry standards and FTC regulations, carat total weight may vary 0.05 carats from stated weight. For diamond jewelry set with multiple diamonds, we provide the minimum total carat weight for the piece. Color and clarity grades are expressed as either a minimum or an average depending on the number of diamonds. If stated as a minimum, all diamonds within the piece are at or above the stated quality. If expressed as an average, collectively the quality is equal to or exceeds the grade stated.

Pure You has complete and unrestricted rights to all jewelry designs, whether standard or custom-made, and may opt to market or sell jewelry based on those designs.

Please note that product details and prices on the Pure You website are subject to change without prior notice. Additionally, to preserve natural resources and maintain the high quality of their pieces, Pure You prohibits purchasing multiple items for comparison purposes. This involves buying several items with the intent of keeping the one that you like the most and returning the others. Pure You and its affiliated companies provide natural diamond origin information, whether on the website, in marketing materials, or materials given to any buyer, without any guarantee or warranty of any kind, either express or implied. The diamond origin information is based on the supplier's information and demonstrated adherence to the Pure You chain of custody protocol. Although reasonable commercial efforts are made to ensure the accuracy of origin information, there can be no guarantee or warranty of the diamond origin information. This limitation of liability applies to anyone who viewed or purchased Pure You natural diamonds listed with origin, as well as to anyone who acquires such diamonds in the future.

Pure You provides all representations, including representations regarding gemstone origin, recycled precious metal content, and estate information, to the best of its knowledge and without any guarantee or warranty of any kind.

When you access or use Pure You's website or your personal account, it is your responsibility to keep your account information confidential and limit access to your computer. You are also accountable for all actions that occur under your account and password. If you are under 18 years of age, you can use our website only with parental guidance. Pure You reserves the right to refuse service, cancel orders, remove or modify content, or terminate accounts at its sole discretion.

If a customer initiates a chargeback, Pure You can cancel promotional items, free shipping, or any benefits and recover direct and indirect costs as determined by Pure You in its sole discretion.

Lab-created diamonds have the same optical, chemical and physical properties as natural diamonds. However, because lab-created diamonds can be produced in abundance, they are less expensive and make larger size diamonds more affordable. Their relative abundance may not ensure that the value will hold over time.

If you order a loose diamond, Pure You will provide a diamond grading report along with it. For lab grown diamonds with GIA grading reports, customers will receive an online certificate via email after purchasing. These grading reports are costly and must be included with any returned diamond to avoid a replacement fee of $300.

Ownership of goods purchased transfers from Pure You to the purchaser's designee upon delivery.

Pure You sends an order confirmation message to acknowledge receiving an order request, but it does not indicate that the order has been approved. Pure You has the right to reject any customer orders for any reason at any time, and the customer will be refunded any payment that has already been collected if their order is canceled.

Customers are encouraged to read Pure You’s Privacy Policy, which outlines how their personally identifiable information is collected, used, and disclosed. Pure You may access and disclose any information it considers necessary or appropriate in response to legitimate governmental requests, subpoenas, or court orders, to protect its systems and customers, or to ensure the integrity and operation of its business and systems.

In accordance with the Digital Millennium Copyright Act ('DMCA') and other applicable law, Pure You has the right to terminate and bar website users or account holders who are determined to be repeat infringers of intellectual property rights. Pure You also reserves the right to limit website access and/or terminate the accounts of any users suspected of infringing others’ intellectual property rights.

Third parties may advertise and promote their products or services on Pure You’s website. These promotions are solely under the direction of the third party, and Pure You is not responsible for any losses, damages, or liabilities that may occur as a result of interactions with third party providers. By submitting such content, you grant Pure You and its sublicensees the right to use your name in connection with such content, if they choose. You represent and warrant that you own or control all the rights to the content you submit or have the right to submit such content to this site, the content is accurate and not misleading, and use and posting of the content will not violate any rights or cause injury to any person or entity.

At times, Pure You may request permission from social media users to feature their User Content, including photos, text, graphics, audio, video, comments, and other materials, on Pure You's site, social channels, or in promotional materials. By responding to such a request, you grant Pure You and its related parties the right to use your social media User Content for any purpose, including but not limited to Pure You's business, product features, marketing, promotional, advertising, and other consumer-related activities. This grant includes a worldwide, perpetual, irrevocable, royalty-free, fully-paid, non-exclusive, transferable, sublicensable right to use your social media User Content in any manner as determined by the Licensed Parties. The Licensed Parties may use, display, reproduce, distribute, transmit, create derivative works from, combine with other materials, alter and/or edit your social media User Content as they see fit, with no obligation to you.

The following is a statement outlining the terms and conditions for using Pure You’s website and social media accounts. By submitting social media User Content, you are granting the Licensed Parties permission to use your username, real name, image, likeness, descriptions of you, location, or other identifying information, including your voice, in connection with the use of your content.

The Licensed Parties reserve the right to remove any social media User Content from the Site. If you believe any content, including social media User Content, residing on the Site infringes any person’s or entity’s copyright rights, please contact Pure You.

Pure You's website and social media accounts currently offer or may offer in the future an Interactive Areas feature where users or third parties can create, post, or store content, messages, materials or other items. It is your sole responsibility to ensure that you use these Interactive Areas in a responsible manner. These Conditions represent the complete agreement between you and Pure You regarding the subject matter herein and supersede any prior agreements or understandings between the parties. The failure of Pure You to enforce any provision of these Conditions shall not be construed as a waiver of any such provision or affect its right to enforce such provision in the future. These Conditions and your use of this Site shall be governed by and construed in accordance with the laws of the State of California, without applying any conflict of law provisions. You agree that any Claims arising from these Conditions or your use of the Site, including disputes, claims, or controversies related to breach, termination, enforcement, interpretation, or validity, shall be resolved by binding arbitration instead of in court, as described below. However, each party retains the right to bring an individual action in small claims court. You also agree that arbitration must proceed on an individual basis and that you waive your right to join or consolidate Claims in arbitration or arbitrate any claims as a representative or member of a purported class. You acknowledge and agree that you are waiving your right to a trial by jury. This arbitration provision shall survive termination of these Conditions and any other contractual agreement with the Company.

By agreeing to these Conditions, you acknowledge and agree that the FAA shall govern the interpretation and enforcement of this provision, and any arbitration shall proceed in San Francisco County, California, before a single arbitrator licensed to practice law, mutually agreed upon by both parties. The arbitration shall be conducted in accordance with the then-prevailing AAA Arbitration Rules, and the arbitrator shall be bound by these Conditions. The arbitrator shall have authority to award or grant legal, equitable, and declaratory relief, and the arbitration shall be final and binding on the parties.
